EB-3 to EB-2 Porting
Upgrade your Green Card priority with EB-2 classification
If you have an approved EB-3 I-140 petition and meet EB-2 qualifications, you may be able to "port" your EB-3 priority date to a new EB-2 petition. This can significantly reduce your Green Card wait time, especially for applicants from countries with long backlogs like India and China.
Eligibility Criteria — U.S. Master's Degree
- Hold a U.S. Master's degree or higher in a relevant field, OR
- Hold a U.S. Bachelor's degree plus 5 years of progressive post-baccalaureate experience
- The new position must qualify as EB-2 (requiring an advanced degree or exceptional ability)
- A new PERM labor certification must be obtained for the EB-2 position
- A new I-140 petition must be filed under EB-2 classification
Eligibility Criteria — Indian Degrees
- Indian 3-year Bachelor's degree + 3-year Master's degree is generally considered equivalent to a U.S. Master's degree for EB-2 purposes
- Indian 4-year Bachelor's degree (e.g., B.E., B.Tech) + relevant work experience may qualify under EB-2
- Credential evaluation from a NACES-member agency is required
- Individual assessments may vary — our immigration team reviews each case thoroughly
